GNA Real Estate – Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the website (“Site”) and services (“Services”) provided by GNA Real Estate (“GNA,” “we,” “us,” or “our”).

By accessing, browsing, reserving, booking, or using any of our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must refrain from using our Services.

1. About GNA Real Estate

GNA Real Estate is a Kenyan real estate firm offering services that include, but are not limited to:

• Real estate brokerage (sales, leasing, and lettings)

• Property sourcing and investment facilitation

• Real estate advisory and consultancy

• Property management

• Furnished apartments, serviced stays, and accommodation reservations

Our Services are provided to local Kenyan clients and international or diaspora clients in relation to properties and investments located within Kenya.

2. Eligibility & User Responsibilities

By using our Services, you confirm that:

• You are at least 18 years of age

• You have the legal capacity to enter into binding agreements

• All information you provide is accurate, complete, and lawful

• You will use the Services only for lawful purposes

GNA reserves the right to refuse, suspend, or terminate Services where these conditions are not met.

3. Scope of Services

3.1 Real Estate & Investment Services

GNA provides brokerage, facilitation, and advisory services as an agent or intermediary, unless expressly stated otherwise in writing.

While we exercise reasonable professional care:

• We do not guarantee property availability, pricing, rental income, capital appreciation, or investment performance

• All transactions are subject to independent due diligence by the client

• Legal conveyancing, tax advice, financing, and regulatory approvals are handled by independent third parties unless otherwise agreed

3.2 Furnished Stays & Accommodation Services

For furnished apartments, serviced stays, and short- or long-term accommodation:

• All reservations are subject to availability and confirmation

• Guests must comply with check-in/check-out times, occupancy limits, and house rules

• Valid identification may be required prior to or at check-in

• Guests are responsible for their conduct and that of accompanying visitors

• Damage, loss, excessive cleaning, or rule violations may result in additional charges

GNA reserves the right to refuse or terminate accommodation without refund where material breaches occur.

4. Property Listings & Investment Disclaimer

All property listings, descriptions, photographs, pricing, availability details, rental estimates, and investment-related information provided by GNA Real Estate are based on information supplied by property owners, developers, landlords, or other third parties.

While reasonable efforts are made to verify information, GNA Real Estate makes no warranties or guarantees as to accuracy, completeness, or continued availability.

GNA Real Estate acts solely as an agent, intermediary, or facilitator and does not own, control, or develop properties unless expressly stated in writing.

Any projections, estimates, forecasts, or statements relating to rental income, investment returns, or capital growth are indicative only and do not constitute financial, legal, or investment advice.

Clients are strongly encouraged to conduct independent inspections and seek professional legal, financial, and tax advice before entering into any transaction.

5. Bookings, Reservations & Payments

• Prices, fees, and commissions are subject to change unless confirmed in writing

• Reservations may require advance payment, deposits, or full settlement

• Applicable cancellation, refund, and rescheduling terms are published on the GNA Real Estate website and may vary by service or property. Such policies form part of these Terms, and clients are responsible for reviewing them prior to making a booking, reservation, or entering into any agreement.

• Failure to meet payment obligations may result in cancellation without liability to GNA

Refunds, where applicable, are processed strictly in accordance with agreed cancellation policies.

6. Client Obligations

You agree to:

• Provide accurate identification and documentation when requested

• Comply with applicable laws, property rules, and community regulations

• Use properties and Services responsibly and lawfully

• Indemnify and hold harmless GNA from losses arising from your breach of these Terms

7. Third-Party Services

Certain Services may involve independent third parties, including:

• Property owners and landlords

• Lawyers and conveyancing advocates

• Valuers, inspectors, and surveyors

• Property managers, caretakers, and hospitality staff

• Banks, payment processors, and financial institutions

GNA is not responsible for the acts, omissions, delays, or performance of independent third parties.

8. Intellectual Property

All content on the Site, including text, images, logos, branding, designs, and materials, is owned by or licensed to GNA Real Estate. No content may be copied, reproduced, distributed, or used without prior written consent from GNA.

9. Limitation of Liability

To the maximum extent permitted by law:

• GNA shall not be liable for indirect, incidental, special, or consequential losses

• We are not liable for losses arising from third-party actions, market conditions, or events beyond our control

• Property condition, availability, and third-party performance are not guaranteed

Any liability attributable to GNA shall not exceed the fees paid for the specific Service giving rise to the claim.

10. Indemnity

You agree to indemnify and hold harmless GNA Real Estate, its directors, employees, and agents from any claims, losses, damages, or expenses arising from:

• Breach of these Terms

• Misuse of Services or property

• Violation of applicable laws or third-party rights

11. Privacy & Data Protection

Your use of the Services is subject to the GNA Real Estate Privacy Policy, which explains how Personal Data is collected, used, stored, and protected in accordance with the Kenya Data Protection Act, 2019.

12. Legal & Regulatory Compliance

GNA Real Estate conducts its business in accordance with applicable laws and regulations of the Republic of Kenya, including but not limited to:

• The Kenya Data Protection Act, 2019

• Applicable land, real estate, and contract laws

• Anti-money laundering (AML) and counter-terrorism financing (CTF) requirements, where applicable

Clients may be required to provide identification, verification documents, or additional information to meet legal, regulatory, or risk management obligations. GNA reserves the right to decline or discontinue Services where compliance requirements are not satisfied.

13. Suspension & Termination

GNA may suspend or terminate access to Services without prior notice where:

• These Terms are breached

• Fraud, misrepresentation, or unlawful conduct is suspected

• Continued engagement poses legal, financial, or reputational risk

Termination does not affect outstanding payment obligations.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Kenya.

15. Amendments

GNA reserves the right to amend these Terms at any time. Updated versions will be posted on the Site with a revised “Last Updated” date. Continued use of the Services constitutes acceptance of the amended Terms.
